Licensing Information, Applications, and Forms

The Division of Funeral, Cemetery, and Consumer Services offers licenses for individuals as well as businesses and establishments. Click to expand each category below for more information on the license types, as well as licensing applications and associated forms.

PLEASE NOTE: Florida Statutes provide that the Division must conduct an initial review of an application for licensure within 30 days of its receipt. Applications are processed in date stamped order. If required items are missing from an application, the Division will send an email to the applicant with a deficiency letter setting out which items are missing. When all items are received, an application is considered “complete.” The Division has an additional 90 days after receiving a completed application to either approve licensure or bring the matter before the Board of Funeral, Cemetery, and Consumer Services (the ”Board”). When the Division’s review process is fully completed, the applicant is emailed a message that the application is approved and either issued under the Division’s designated authority from the Board or being presented to the Board for review. Calling the Division's office in an attempt to speed up this process, while permitted, may actually result in unnecessary delays to the overall application process.

Individual License Categories (click to expand list)

Broker of Burial Rights - a person who receives compensation to act as a third party to the sale or transfer of three or more burial rights in a 12-month period. (Additional information on licensure requirements is found in section 497.281, Florida Statutes, and rule 69K-5.012, Florida Administrative Code.)

Concurrent Intern (funeral director and embalmer intern)a person who is fulfilling the internship requirements for a combination license as both funeral director and embalmer. These internship requirements may be served concurrently pursuant to rules adopted by the licensing authority. An applicant for concurrent internship must meet all the separate requirements for the funeral director internship and the embalmer internship. A full-time internship training served concurrently consists of both funeral director and embalming activities. Direct Disposer - any person licensed under chapter 497, Florida Statutes, to practice direct disposition in this state. The “practice of direct disposition” means the cremation of human remains without preparation of the human remains by embalming and without any attendant services or rites such as funeral or graveside services or the making of arrangements for such final disposition. (Additional information on licensure requirements is found in section 497.602, Florida Statutes, and rules 69K-23.001 and 69K-23.002, Florida Administrative Code.)

Embalmer Apprentice – an individual participating in an embalmer apprentice program. An embalmer apprentice may perform only those tasks, functions, and duties relating to embalming which are performed under the direct supervision of an embalmer who has an active, valid license. An embalmer apprentice is eligible to serve in an apprentice capacity for a period not to exceed 3 years. However, under certain circumstances, the apprentice license may be extended for an additional 2 years. Embalmer Intern – an individual engaged in learning the practice of embalming under the instruction and supervision of a licensed embalmer. An embalmer intern may perform embalming related-tasks only under the direct supervision of a Florida licensed embalmer in good standing. Direct supervision means responsible supervision and control, with the licensed embalmer providing both initial direction as well as periodic inspection of the work. The supervising embalmer shall be physically present or on the premises at all times when the intern is performing the services. An internship consists of 40 hours a week of embalming related work, for 50 weeks, completed within the contiguous 52-week period following issuance of the internship license. Embalmer – an individual licensed under chapter 497, Florida Statutes, to practice embalming in this state. The “practice of embalming” means disinfecting or preserving or attempting to disinfect or preserve dead human bodies by replacing certain body fluids with preserving and disinfecting chemicals. An embalmer directly supervising an embalmer intern or apprentice provides initial direction and instruction regarding the preservation of a dead human body in its entirety or in part and must be physically present or on the premises of the funeral establishment or embalming facility at all times when the tasks, functions, and duties relating to embalming are performed. Funeral Director and Embalmer (combination license) - a person who holds a license as a funeral director and a license as an embalmer at the same time. A person holding a combination license as a funeral director and an embalmer is subject to regulation under chapter 497, Florida Statutes, both as a funeral director and an embalmer. Funeral Director Intern - an individual engaged in learning the practice of funeral directing under the instruction and supervision of a licensed funeral director. A funeral director intern may perform funeral director related tasks only under the direct supervision of a Florida licensed funeral director. (Additional information on licensure requirements is found in section 497.375, Florida Statutes, and 69K-18.002, Florida Administrative Code.)

Funeral Director – any person licensed under chapter 497, Florida Statutes, to practice funeral directing in this state. The “practice of funeral directing” includes selling or offering to sell funeral services; removal of human remains from the state, on an at-need basis; planning or arranging funeral services, embalming, cremation or other services relating to final disposition on an at-need basis; and directing, being in charge or apparent charge of, or supervising, any funeral service held in a funeral establishment, cemetery, or elsewhere. Persons licensed as funeral directors under chapter 497, Florida Statutes, may engage in preneed sales for the preneed licensee with whom they are affiliated. A funeral director may only operate in affiliation with a licensed business. (Additional information on licensure requirements is found in section 497.372, Florida Statutes.)

Monument Establishment Sales Agent – a licensed individual selling any product used for identifying a grave site and cemetery memorials of all types, including monuments, markers, and vases. Each person selling monuments, markers, or related products for a monument establishment must be licensed under chapter 497, Florida Statutes. Preneed Sales Agent - any person who is licensed under chapter 497, Florida Statutes, to sell preneed burial or funeral service and merchandise contracts or direct disposition contracts in this state. All persons who offer preneed contracts to the public, or who execute preneed contracts on behalf of a preneed licensee, including all persons who offer, sell, or sign contracts for the preneed sale of burial rights must be licensed under chapter 497, Florida Statutes.
